IMPORTANT TERMS, ASSUMPTIONS & CONDITIONS

1. Standard Inclusions

Unless otherwise stated, our domestic boiler replacement quotations include:

  • Supply and installation of the new boiler as specified
  • Standard horizontal flue installation
  • One FREE wireless room thermostat
  • FREE system filter supplied and installed
  • Full commissioning in accordance with manufacturer requirements
  • Registration of the manufacturer’s warranty
  • Gas Safe certificate upon completion
  • Removal and disposal of the existing boiler
  • Minor pipework alterations to suit the new boiler

For some manufacturers, installation of a system filter may contribute toward extended warranty eligibility (subject to manufacturer terms and conditions).

Note: Vertical flue installations are not included unless specified or selected.

2. General Pricing Information

  • All prices are estimates only and subject to site survey.
  • Final pricing may change following inspection of:
  • Property condition
  • System condition
  • Access
  • Compliance with current regulations

3. Standard Installation Assumptions

Prices are based on a standard installation defined as:

  • Like-for-like boiler replacement (unless otherwise selected)
  • Existing pipework is suitable and compliant
  • Reasonable access to the installation location
  • Standard working hours
  • No unforeseen structural or compliance issues

Any deviation from the above may result in additional costs following the site survey.

4. Works Not Included As Standard

(Chargeable if required or selected)

Unless specified, the following are excluded:

  • Boiler relocation (unless selected)
  • Upgrades to heating, hot water, or gas pipework
  • Relocation of cylinder or associated services
  • New core holes for flues
  • Flue extensions, additional bends, non-standard routes
  • Electrical upgrades beyond basic connection
  • Gas supply upgrades or meter alterations
  • Power flushing
  • Replacement of system components not listed in the quotation

5. Access, Parking & Travel Costs

Our quotations generally allow for standard travel costs, including parking, congestion and ULEZ charges where reasonably anticipated at the time of quotation.

However, Portman UK reserves the right to apply additional charges where unforeseen or excessive costs arise, including but not limited to:

  • Exceptional parking charges
  • Additional congestion or toll charges
  • Permit costs
  • Specialist access permits
  • Road closures
  • Restricted access requirements
  • Traffic management requirements

Any such costs will be identified and confirmed following the site survey.

6. Making Good & Decorative Works

(Optional / Chargeable)

Not included as standard:

  • Boxing-in pipework
  • Plastering, tiling, painting, decorating
  • Joinery or cosmetic repairs
  • Floor or wall finishes

Pipe penetrations will be sealed for safety purposes only unless agreed otherwise.

7. Access & Working Conditions

Not included unless specified:

  • Scaffolding
  • Cherry pickers or specialist access equipment
  • Unsafe or restricted working environments
  • Excessive working at height beyond standard ladder access

Specialist access requirements will be assessed and quoted separately.

8. Electrical Works

Included:

  • Basic boiler electrical connection (where a suitable supply exists)

Chargeable if required:

  • Consumer unit upgrades
  • New electrical circuits
  • Major rewiring
  • Electrical upgrades outside boiler requirements

9. Gas Supply

Not included as standard:

  • Gas pipe upgrades
  • Meter relocation
  • External gas works

If the existing supply is undersized or non-compliant, upgrades will be quoted separately.

10. Flues & Compliance

Included:

  • Standard horizontal flue installation

Chargeable if required:

  • Vertical flue installations
  • Manufacturer-specific vertical flue kits
  • Flue extensions or bends
  • Roof flashing kits
  • Roof works (tile/slate cutting and making good)

Vertical flue installations are non-standard and subject to separate quotation.

11. Heating System Condition

Not included unless specified:

  • Power flushing
  • Remedial pipework repairs
  • Replacement of faulty valves, pumps, or unspecified components
  • Major re-piping or system alterations

12. Controls & Zoning

Included:

  • Controls selected at the quotation stage

Chargeable if required:

  • Additional heating zones
  • Multiple thermostats beyond the selected package
  • Smart radiator valves

13. Hot Water Cylinders

Cylinder upgrades are subject to:

  • Cylinder size
  • Location
  • Discharge pipework route
  • Electrical requirements

Complex discharge routes, access issues, or additional requirements may increase final cost.

14. Waste & Asbestos

(Specialist / Chargeable)

Included:

  • Removal and disposal of the existing boiler

Chargeable if required:

  • Asbestos identification, testing, and removal
  • Specialist hazardous waste removal

All asbestos works must be carried out by licensed contractors.

15. Commercial & Non-standard Installations

Not included as standard:

  • Commercial or industrial systems
  • Plant rooms or high-output installations
  • Non-domestic properties requiring bespoke design

These require a separate quotation.

16. Payment Terms

Acceptance of Quotation

Acceptance of this quotation confirms acceptance of Portman UK’s Terms & Conditions, together with the assumptions, exclusions, and payment terms detailed herein.

Deposit

Portman UK reserves the right to request a deposit of up to 50% of the quotation value prior to commencement of works.

Where a deposit is required, the amount will be clearly stated within the quotation. No materials will be ordered, and no installation dates will be secured until the required deposit has been received and cleared.

Final Payment

The remaining balance is due immediately upon completion of the works, unless otherwise agreed in writing prior to commencement.

Late Payment

Portman UK reserves the right to charge interest and reasonable debt recovery costs on overdue accounts in accordance with applicable legislation. Any costs incurred in recovering outstanding debts shall be payable by the client.

Ownership of Materials

All materials, equipment, and goods supplied by Portman UK shall remain the property of Portman UK until payment has been received in full.

Suspension of Works

Portman UK reserves the right to suspend works, withhold labour, delay attendance, and withhold commissioning, certification, warranties, manuals, and handover documentation where payments become overdue.

Variations

Any additional works requested by the client that fall outside the agreed scope shall be subject to a separate charge and may require written approval before commencement.

Access & Delays

The client shall provide suitable access, services, and permissions required to complete the works.

Delays caused by restricted access, third parties, building management, landlords, leaseholders, freeholders, managing agents, or other factors beyond Portman UK’s control may result in additional charges.

Quotations

This quotation is based upon the assumptions detailed within the quotation.

Any unforeseen conditions discovered during the works may require additional costs, which will be discussed and agreed before proceeding.

Validity

This quotation is valid for 30 days from the date of issue unless otherwise stated.

Terms & Conditions

17. Variations & Additional Works

Any works outside the agreed scope or identified during installation/site survey:

  • Will be treated as a variation
  • Discussed and agreed before proceeding
  • May incur additional cost

18. Delays Outside Our Control

We are not liable for delays caused by:

  • Manufacturer/supplier delays
  • Weather conditions
  • Third-party contractors

Installation dates may be adjusted accordingly.

19. Client Responsibilities

  • The immediate work area will be reasonably protected
  • The client must remove or protect personal belongings prior to commencement

20. Warranty & Limitations

We provide:

  • 12-month labour warranty on workmanship

Manufacturer warranties apply to appliances and components, subject to manufacturer terms.

Warranty does not cover:

  • Existing components have not been replaced
  • Misuse or lack of maintenance
  • Third-party interference

21. Cancellation Or Postponement

Cancellations or postponements with less than 24 hours’ notice may incur reasonable charges for:

  • Labour
  • Materials
  • Allocated time

22. Right To Amend Or Decline Works

We reserve the right to:

  • Amend pricing
  • Decline works

If installation is deemed unsafe, non-compliant, or not economically viable following site survey.

PORTMAN UK

These Terms & Conditions apply to all works, services, quotations, installations, maintenance, servicing, repairs, reactive callouts, and associated works carried out by Portman UK and all associated divisions, including but not limited to:

  • Plumbing
  • Building Services
  • Cooling & Air Conditioning
  • Electrical
  • Roofing
  • Renewables
  • Drainage
  • Property Maintenance
  • Mechanical Services
  • General Building & Associated Works

By instructing Portman UK (“the Company”) to proceed with any works, the Client agrees to the following Terms & Conditions.

1. QUOTATIONS & ACCEPTANCE

1.1 All quotations are valid for 14 days unless otherwise stated in writing.

1.2 Quotations are based on the information available at the time of survey, discussions, drawings, photographs, specifications, or client instruction.

1.3 Any works outside of the original quotation scope shall be treated as additional works and may incur further charges.

1.4 Acceptance of a quotation, estimate, purchase order, email confirmation, text/WhatsApp confirmation, site instruction, or instruction to proceed shall constitute acceptance of these Terms & Conditions.

1.5 The Company reserves the right to amend or withdraw quotations prior to formal acceptance.

2. VARIATIONS & ADDITIONAL WORKS

2.1 Any additional works, upgrades, alterations, remedial works, unforeseen works, or client changes requested after commencement may be chargeable.

2.2 Variations should be approved verbally or in writing before work proceeds, where reasonably possible.

2.3 Emergency safety-related works required to make systems, properties, or installations safe may proceed without prior approval where immediate action is reasonably necessary.

2.4 The Company shall not be responsible for delays or additional costs caused by:

  • Client changes
  • Supplier shortages
  • Delivery delays
  • Third-party contractors
  • Restricted access
  • Building management delays
  • Structural issues
  • Existing system defects
  • Unforeseen site conditions

3. ACCESS & SITE CONDITIONS

3.1 The Client shall provide safe and reasonable access to all required working areas.

3.2 The Client is responsible for ensuring:

  • Suitable parking/access
  • Water supply
  • Electrical supply
  • Permissions/access arrangements
  • Safe working environment

3.3 The Company reserves the right to suspend works where working conditions are unsafe, abusive, unsuitable, or non-compliant with health & safety requirements.

3.4 Additional charges may apply for:

  • Parking costs
  • Congestion/ULEZ charges where applicable
  • Waiting time
  • Abortive visits
  • Restricted access
  • Delayed access
  • Out-of-hours requirements
  • Traffic delays
  • Site attendance outside agreed scope

4. EXISTING SYSTEMS, STRUCTURES & CONCEALED DEFECTS

4.1 The Company cannot be held responsible for faults, failures, leaks, corrosion, blockages, electrical faults, roofing defects, drainage failures, structural weaknesses, pipework failures, or defects relating to existing systems, installations, or structures.

4.2 Existing systems and structures may contain hidden or pre-existing defects that only become apparent during or after works commence.

4.3 The Company shall not be liable for the failure of existing:

  • Boilers
  • Pipework
  • Cylinders
  • Pumps
  • Radiators
  • Valves
  • Roof coverings
  • Drainage systems
  • Electrical systems
  • Solar systems
  • Fixtures
  • Finishes
  • Structural elements

due to age, wear and tear, corrosion, scale, sludge, movement, historic defects, poor previous workmanship, weathering, or unsuitable system design.

4.4 Any concealed defects discovered during works may require additional remedial works at additional cost.

5. MECHANICAL, ELECTRICAL & BUILDING SYSTEMS

5.1 Existing systems are tested visually and operationally where reasonably accessible, but cannot be guaranteed free from defects.

5.2 The Company does not guarantee the condition, lifespan, performance, or compatibility of existing systems unless specifically confirmed in writing.

5.3 Plumbing, building services, cooling, roofing, renewable, drainage, and electrical systems may contain historic defects, corrosion, blockages, sludge, scale, deterioration, water ingress, design faults, or non-compliant installations outside of the Company’s control.

5.4 Where systems are deemed unsafe, defective, non-compliant, or beyond economical repair, the Company reserves the right to isolate, disconnect, cap, condemn, or make safe as required.

5.5 Any certification, testing, inspection, or commissioning applies only to systems and equipment reasonably accessible and testable at the time of attendance.

6. ELECTRICAL, RENEWABLE & COOLING WORKS

6.1 Electrical, renewable energy, cooling, and air conditioning works are subject to site suitability, manufacturer requirements, and current regulations.

6.2 The Company shall not be responsible for:

  • Pre-existing electrical faults
  • Inadequate electrical supplies
  • Existing wiring defects
  • Inadequate earthing
  • Network/supply issues
  • Roof condition defects
  • Structural movement
  • Existing water ingress
  • Manufacturer failures

6.3 Additional remedial works may be required following inspection, testing, commissioning, or opening-up works.

6.4 Unless specifically included in writing, the following are excluded:

  • Decorative making good
  • Redecoration
  • Structural works
  • Scaffolding
  • Specialist access equipment
  • Roof strengthening
  • Builder’s works
  • Asbestos removal
  • Network upgrades
  • Planning applications
  • Specialist surveys

7. DAMAGE, DECORATION & MAKING GOOD

7.1 Whilst reasonable care shall always be taken, the Company cannot guarantee disturbance-free works.

7.2 Minor cosmetic damage, cracking, movement, disturbed finishes, lifted flooring, damaged plaster, damaged decorations, marks, tile damage, roof disturbance, or access-related disturbance may occur during works.

7.3 Unless specifically included, making good, redecorating, flooring repairs, plastering, roofing decoration, specialist finishes, tiling, joinery, or decoration works are excluded.

7.4 Clients are responsible for protecting valuables, furniture, flooring, decorations, IT equipment, stock, and personal belongings within or near the working area.

8. WARRANTIES & GUARANTEES

8.1 Manufacturer warranties apply only where products are installed, commissioned, serviced, and maintained in accordance with manufacturer requirements.

8.2 The Company’s workmanship warranty applies only to workmanship directly carried out by the Company.

8.3 The Company does not warrant:

  • Existing systems
  • Customer-supplied materials
  • Third-party workmanship
  • Pre-existing defects
  • Unsupported systems

8.4 Warranty claims become void where systems are:

  • Altered
  • Misused
  • Poorly maintained
  • Interfered with
  • Worked on by third parties

8.5 The Company shall not be liable for manufacturer defects, supplier delays, warranty claim delays, or product failures outside of its control.

9. PAYMENTS

9.1 Payment is due immediately upon completion of works unless otherwise agreed in writing prior to commencement.

9.2 The Company reserves the right to request:

  • Deposits
  • Stage payments
  • Interim payments
  • Full payment upfront

depending on the size and nature of the works.

9.3 Failure to make payment in accordance with agreed terms may result in:

  • Suspension of works
  • Withdrawal from the site
  • Cancellation of warranties
  • Removal of credit facilities
  • Debt recovery action
  • Interest and recovery charges

9.4 Commercial clients may be charged statutory interest and compensation under the Late Payment of Commercial Debts legislation.

9.5 Ownership of all supplied materials shall remain with Portman UK until full payment has been received and cleared.

10. CANCELLATIONS & ABORTED VISITS

10.1 The Company reserves the right to charge for:

  • Cancelled appointments
  • Missed appointments
  • Abortive visits
  • Ordered materials
  • Allocated labour
  • Specialist equipment hire
  • Parking/congestion charges already incurred

10.2 Special-order or non-returnable materials may be non-refundable.

11. FORCE MAJEURE

The Company shall not be liable for delays, losses, or inability to perform works due to events beyond reasonable control, including:

  • Supplier delays
  • Utility outages
  • Traffic delays
  • Weather conditions
  • Government restrictions
  • Labour shortages
  • Strikes
  • Third-party failures
  • Acts of God

12. LIMITATION OF LIABILITY

12.1 The Company’s liability shall be limited to the value of the works directly carried out by the Company.

12.2 The Company shall not be liable for:

  • Consequential losses
  • Loss of earnings
  • Business interruption
  • Tenant disruption
  • Existing system failures
  • Water ingress from historic defects
  • Roofing failures relating to existing structures
  • Third-party contractor issues
  • Delays outside reasonable control

12.3 Clients are responsible for maintaining suitable insurance cover for their property, systems, contents, business operations, and associated risks.

13. HEALTH & SAFETY

13.1 The Company reserves the right to stop works immediately where unsafe conditions arise.

13.2 Clients and third parties must not interfere with:

  • Tools
  • Equipment
  • Isolation points
  • Safety equipment
  • Access equipment
  • Scaffolding
  • Temporary works

13.3 The Company operates in accordance with relevant UK health & safety legislation and industry guidance.

14. GENERAL

14.1 Estimated timescales are approximate only and not guaranteed.

14.2 The Company reserves the right to subcontract specialist works where required.

14.3 No verbal statement shall override these Terms & Conditions unless confirmed in writing.

14.4 If any part of these Terms & Conditions is deemed unenforceable, the remaining sections shall remain valid.

14.5 These Terms & Conditions shall be governed by the laws of England & Wales.
